中国发布了新的外商投资产业指导目录草案
China issues a new draft of the FDI Catalog

最近中国发布了新的外商投资产业指导目录的修订稿草案。从草案内容来看本次修订拟扩大开放的范围，比如在采矿业，过去对贵金属和锂矿方面有外资持股股比的限制，现在拟取消该限制；在服务业方面，资信调查和评级服务也首次拟对外资开放。
Recently China issues a new draft of the FDI Catalog. From the content of this draft, China plans to enlarge the scope which foreign investors are allowed to invest. For example, this draft plans to cancel the limit on the foreign investor’s shareholding percentage in certain fields in mining industry of precious metal and lithium; this draft also plans to for the first time allow foreign investor to provide credits investigation service and rating service.

此外，本次修订拟将限制性和禁止类的条目总数从93条缩减到62条，并将该些条目和鼓励类项目当中有股比要求的一些条目整合成一外商投资的准入的负面清单。
In addition, this draft aims to decrease the total number of restrictive and prohibited industries from the existing 93 to 62 and integrates such industries with the industries which have requirements on foreign shareholding percentage in the encouraged industries into a negative list for foreign investment.

另外，一些限制类和禁止类项目由于本身根据中国其他法律法规就是禁止的，此次草案中不再出现。体现出中国对于外资和内资同样管理的原则。
Furthermore, since certain restrictive and prohibited industries are banned by China’s laws and regulations even for domestic investment, this draft will not lists these industries. This reflects that China aims to equally administer foreign investment and domestic investment.
